Ditch Criminal Whitehaven Coal

Whitehaven Coal is being sentenced in criminal court on 9 April for conducting unsafe blasting at their Maules Creek mine. The blast, overloaded by 41,000 tonnes of explosive, had effects as far as 30 kilometres from the mine and injured up to 4 people.

  • Nippon Steel, Japan's largest steelmaker. Owns 20% of Whitehaven Coal's Blackwater mine.

  • JFE Steel, Japan's second largest steelmaker. Owns 10% of Blackwater.

  • J-Power, power company in Japan reliant on thermal coal. Owns 10% of Maules Creek.

  • Itochu, a diversified trading house who broke their promise to exit thermal coal. Still owns 15% of Maules Creek.

We encourage you to send a customised email. Why not add a simple, short paragraph introducing yourself (in English or Japanese) and why you think associating with criminal companies is risky business.

Our research shows that in Japanese companies, there are often multiple executives and heads of departments who are consulted in decision-making. We would really appreciate it if you can take a little extra time to take action targeting a wider range of executives and staff from each company. You will be prompted to click on a link to a second template email after sending the first one.

Translation here:

Dear CEO,

I am sure you are aware that you are partnered with Whitehaven Coal - a company that has now been criminally convicted as guilty and is being heard for sentencing in relation to the matter.

Whitehaven Coal has been unsuccessfully defending itself in court for criminal negligence whilst blasting at its Maules Creek mine in New South Wales. The company overloaded a blast by more than 41,000 kilograms of explosive leading to damage and injuries for homes and people in a 30 kilometre radius of the mine.

This criminally negligent company has also been one of the reasons that billion-dollar Australian pension fund ActiveSuper was fined AU$10.5 million. The judgement was delivered on the basis that the fund had misled customers by remaining invested in companies like Whitehaven Coal whilst claiming it was an ethical fund.

By associating with the criminal company Whitehaven Coal, you are taking on similar risks of misleading customers around your claims of decarbonising and greening your steel. As Whitehaven Coal continues to grow the scale of its operations, your investments will contribute to climate pollution, emissions, operational risks, and financial and stranded asset risks that climate change will bring. Increasingly, as more Australians face climate disasters that are fuelled by fossil fuel exports, they will also hold miners and their corporate partners liable for damage from these disasters.

It is clear from Whitehaven Coal’s track record that they are incapable of changing their ways. As responsible operating companies, it is up to you as their joint venture partners to ensure that Whitehaven Coal is  operating responsibly and not endangering lives through its incompetence and its extensive plans to expand production.

I urge you to cleanse yourself from the shame that comes with being associated with the criminal company Whitehaven Coal. If you are unable to do so, I urge you to at least commit to not participating in any of their upcoming projects - greenfield or expansion.

I hope you will positively embrace this suggestion as one that has the planet and your best interests at heart. It is unwise to be too close to criminal elements and Whitehaven Coal continues to embody a criminal ethic in the way it operates.

Thank you for reading this email.
